What a California notary can and cannot do

A California notary public is an impartial witness to the signing of a document. The notary verifies the signer's identity, administers oaths and affirmations, and completes the notarial certificate. A notary may not draft your document, may not tell you which document or certificate you need, and may not give legal advice.

Two practical rules save wasted trips. Every applicable blank in the document must be filled in or marked "N/A" before the appointment, and you must present a current, unexpired government-issued photo ID bearing a signature, physical description, and identifying number.

If the signer has no qualifying ID, California law allows identification by credible witnesses instead. One credible witness who personally knows the signer and who is personally known to the notary may establish identity, or two credible witnesses who personally know the signer and who present their own acceptable ID may do so. In either case each witness signs the notary journal, swears under oath to the signer's identity, and must have no financial interest in and not be named in the document. Tell us in advance if you plan to use witnesses so we can confirm the arrangement will work before we come out.

What it costs

California caps notary fees by statute. Under Government Code section 8211, a notary may charge up to $15 per signature notarized for acknowledgments and jurats. That cap is set to increase to $20 per signature effective January 1, 2027 under AB 1597.

On top of the per-signature fee, a mobile notary may charge a separate travel fee, which is not capped by statute but must be agreed to in advance. Our travel fee starts at $50 and depends on distance and time of day, and it is agreed with you before we come out.

Hospital, care facility, and jail signings

Hospital and skilled nursing facility signings are a routine part of mobile notary work, and we handle advance health care directives, powers of attorney, and estate documents in those settings regularly. Correctional facility signings are possible but require advance coordination with the facility. Call as early as you can, because facility scheduling, not our availability, is usually the constraint.
